Is an electric grill allowed on the balcony?

Rental law requirements

Basically, the rental law generally does not prohibit barbecues on the balcony or on the terrace. As long as the lease does not provide for an explicit ban on this point (of course you have to be a tenant), there are no restrictions on tenancy. Neighbors have to tolerate the crickets in principle.

Restrictions in the lease

Restrictions in the lease can also be confined to barbecuing with charcoal, as this can cause unreasonable burdens for the neighbors due to smoke and smoke. With an electric grill (and also a gas grill) this is not the case.

However, if there is a restriction and you violate it, this can lead to a warning by the landlord and even to the termination of the lease. This has already been confirmed in court in some judgments.

Harassment by the smoke

If strong smoke or smoke pulls into a neighboring apartment, or a strong odor nuisance for the neighbors arises, this can be a reason in NRW and Brandenburg that the neighbors refuse, citing the applicable local immigration protection law against it. This is only possible in these two federal states.

But as far as you can avoid that, you should do that anyway. It is never a good idea to expose your neighbors to an unreasonable harassment, and it often destroys neighborly relations quite quickly and quite sustainably.

How often is barbecue allowed on the balcony?

The court judgments on this point differ considerably from each other, so in most cases you will have to consult with neighbors in individual cases and make arrangements.

The AG Bonn, for example, considered only once a month as justifiable, the neighbors should be informed according to this judgment at least 48 hours in advance. Twice a month, the LG Aachen considered admissible, in a ruling by the LG Stuttgart, the judges expressed, however, that you consider three barbecues or six hours a year as appropriate.

Tips & Tricks

Of course you should also take care of the night's sleep: from 22 to 7 o'clock one must not disturb neighbors by noise excessively. This can lead to a warning by the police and further continued to lead to a fine. However, there are some concerns about this when it comes to being indoors.
